Contract, Vertrag, Rechtsgeschäft, dessen Absicht auf die Begründung einer obligatio geht. Mit bestimmtem Namen und fester Klageformel (z.B. Kauf, Pfand u.s.w.) heißt der C. benannter (nominatus); ohne jene Requisite unbenannter (innominatus), wobei sich die Klage nach dem jeweiligen Sachverhältniß gestaltet (inserta actio; praescriptis verbis oder in factum actio). – Es gibt aber auch Rechtsgeschäfte, welche, ohne daß diese Wirkung in der Absicht der Handelnden liegt, Obligationen begründen und dann quasi ex contractu heißen, z.B. Uebernahme einer Vormundschaft, negotiorum gestio, Erbschaftsantritt.
