Exemplary damages

Im angelsächsischen Recht versteht man unter Punitive damages (exemplary damages im englischen Recht) Schadensersatz, der im Zivilprozess einem Kläger über den erlittenen realen Schaden hinaus zuerkannt wird. In Deutschland hat sich hierfür der Begriff Strafschadensersatz eingebürgert.

Im deutschen und österreichischen Recht gibt es bisher kein vergleichbares Rechtsinstitut.

Der Zweck ist

  1. den Beklagten für sein Verhalten zu bestrafen (Repression);
  2. ihn davon abzuhalten, erneut dieses rechtswidrige Verhalten zu setzen (Spezialprävention);
  3. auch andere davon abzuhalten (Generalprävention).

Punitive damages werden grundsätzlich nur für außergewöhnlich grob schuldhaftes, vorsätzliches Verhalten zuerkannt, nicht hingegen bei bloßer Fahrlässigkeit.

Ein den Punitive damages vergleichbares Rechtsinstitut wurde im Jahr 2006 durch das Allgemeine Gleichbehandlungsgesetz in Deutschland für den Bereich des Arbeitsrechts eingeführt. Mit dem Gesetz wurden die EU-Richtlinien 2000/43, 2000/78 und 2002/73 nach zum Teil mehrjähriger Verzögerung umgesetzt.
