Works of the United States Government

Ein Werk der Regierung der Vereinigten Staaten (engl.: Work of the United States Government) ist ein Werk, das von einem Beamten oder Angestellten der Bundesregierung der Vereinigten Staaten in Ausübung seiner dienstlichen Pflichten erstellt wurde. Werke der Regierungen eines Bundesstaats oder lokaler Behörden fallen nicht darunter.

Diese Werke sind nach US-amerikanischem „copyright law“ grundsätzlich in der Public Domain. Diese Regelung bezieht sich ausschließlich auf das Urheberrecht. Unberührt bleiben Beschränkungen nach anderen Gesetzen. Beispielsweise darf das Logo der CIA nach dem CIA Act von 1949[1] nur mit Zustimmung der CIA verwendet werden.

Die Gemeinfreiheit besteht grundsätzlich nur innerhalb der USA, wie ein Senat-Report von 1976 klargestellt hat. Allerdings kann man davon ausgehen, dass fast alle betroffenen Regierungsbehörden die Nutzung außerhalb der USA dulden. Beispielsweise hat die FWS Image Library 2004 ausdrücklich erklärt, dass ihre Bilder weltweit frei genutzt werden könnten. Andererseits ist von der Library of Congress bekannt, dass bestimmte Produkte mit einem Rechtevorbehalt außerhalb der USA versehen sind.
