Writ of certiorari

Certiorari ist ein Rechtsterminus (lat. certioro, certiorem facio – etwa bestimmen, zulassen, bestätigen), der auf die Prozesslehre von Ulpian zurückgeht und die Prozesshandlung bezeichnet, mit der ein übergeordnetes Gericht (iudex ad quem) sich an ein untergeordnetes Gericht (iudex a quo) wendet, um seine Entscheidung zu überprüfen.

Heute wird der Terminus frei übersetzt mit „sende die Akten“, in dem allgemeinen Sinne, dass eine übergeordnete Stelle die Akten bei einer untergeordneten anfordert.

Insbesondere in den USA bezeichnet der Terminus (auch "cert" oder "certworthy") einen Verfahrensschritt als Kombination der Zulassung eines eingelegten Rechtsmittels und der Kundgabe des Devolutiveffekts nach außen, Bestätigung der Appellationszulassung. Das Rechtsmittelgericht erlässt in diesem Fall ein writ of certiorari.
