Actio in personam

Die actio in personam ist ein Rechtsinstitut des römischen Privatrechts.

Die actio in personam wendet sich als Leistungsklage gegen einen Verpflichteten und macht eine obligatorische Forderung geltend.

Nach römisch-rechtlichem Verständnis, das den der actio zugrunde liegenden Anspruch mit der Möglichkeit seiner prozessualen Geltendmachung identifiziert, decken sich in diesem Falle also das geltend gemachte Recht und die erhobene actio in personam.

Das Gegenstück zur actio in personam ist die actio in rem, mit welcher ein Anspruch gegen jedermann, der das dem Berechtigten zustehende Recht beeinträchtigt, geltend gemacht wird.

Die actio in personam kann also nur zur Durchsetzung relativer Rechte herangezogen werden, während die actio in rem der Durchsetzung absoluter Rechte dient.
